Accordingly, Mr Innes had his license to ride in races suspended for a period to commence after racing on 23 September and conclude after racing on 4 October 2018.
Facts:
Following the running of race 1, Colliers International 2 YO, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Coles, alleged that Mr Innes allowed his mount JAGER BOMBED to shift in when not sufficiently clear of TAPPY’S ONE which was checked near the 700 metres.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Innes said that he understood the Rule and confirmed that he admitted the breach.
Mr Jones demonstrated the incident using the available video footage. He identified that Mr Innes had drawn the outside gate and showed that he allowed his mount to shift into the running line of TAPPY’S ONE when only a bare length clear. As a result Ms Spratt had to check her mount. He added that there was a slight shift from the inside horses but the major shift was from JAGER BOMBED.
Mr Innes said that in mitigation FIRST ROCK, ridden by Ms Grylls, shifted out half a horse width which contributed to the incident. He believed that TAPPY’S ONE over reacted when it was checked.
Submissions for Penalty:
Mr Coles produced Mr Innes’ record which showed 2 previous breaches under this Rule in the last 12 months. He said the level of carelessness was in the low to mid-range.
Mr Innes advised that he had no upcoming engagements and any proposed suspension could start immediately.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented.
The Committee observed that 100 metres after the start Mr Innes angled his mount in when only 1 length clear of TAPPY’S ONE. As a result that runner suffered a check losing approximately 3 lengths. We accept that FIRST ROCK shifted out slightly but at no stage did Mr Innes take reasonable steps to avoid causing the interference. The Committee deemed the level of carelessness displayed by Mr Innes was low to mid-range.
The JCA Penalty Guide starting point for low to mid-range carelessness is 7 days which was adopted.
There were no aggravating factors to warrant an uplift in penalty.
The mitigating factors were Mr Innes’ admission of the breach and his good record. For these combined factors Mr Innes was afforded a 1 day reduction in penalty.
After taking into account all the above factors the Committee considered that an appropriate suspension was 6 national riding days.
