Decision:

As the charge was admitted, it was deemed proved.

Penalty:

Mr. Riddell you are fined the sum of $300.00.

Charge:

Alledged breach of ruls 330 (3) (c)

Facts:

J. Riddell was unable to make the agreed weight on Fives A Diamond in Race 8 and Son of Grace in Race 10.

Submissions for Penalty:

Mr. Goodwin informed the committee that Mr. Riddell came to him during the early part of the race day stating he was unable to make the two horses carded weight. Both horses were carded to carry 56kgs and that Mr. Riddell informed him he was ¾ of a kilo over.
Mr. Goodwin told the committee that Mr. Riddell struggles with his weight and was last charged on the 15th of January and fined $300. He submitted that a monetary penalty be imposed as the length of time since the last breach was just over 110 days. He was a busy rider who is keenly sought after by owners and trainers.
Mr. Riddell commented that he did consider pushing himself during the day to meet his obligations on the two horses concerned but realised it would put pressure on himself.

Reasons for Penalty:

In coming to our decision Mr. Riddell, this committee has taken into account your admittance of the breach and the relatively early approach to the stewards you made when you realised you would not be able to fulfil your riding obligations in Races 8 and 10.

We have also noted that it was in early January 2011 since your last breach of this rule, and the submission from Mr. Goodwin who commented on your struggle with weight issues.
However, jockeys have an obligation upon accepting rides to ensure the weight allocated is adhered to.
