Facts:

Following the running of the RA & JV YARNDLEY 2YO DIAMOND, an Information was lodged by Chief Stipendiary Steward, Mr N Ydgren against Open Horseman, Mr M Purdon alleging that Mr Purdon was out of position at the start when driving KAYLA MARIE.

Rule 857(7)(g) provides : No horseman shall fail to come up into and/or maintain his position.

Mr Purdon admitted the breach and noted on the Information that he did not wish to be present at the hearing.

Mr Ydgren demonstrated the incident by use of the race films and showed where Mr Purdon was initially up on the barrier but allowed his horse to drift back and was at least one length back at the start. He said that Mr Purdon's horse was not giving any trouble and it was an intentional action on Mr Purdon's part.

Submissions for Penalty:

Mr Ydgren submitted that a fine of $200 was appropriate in this case because Mr Purdon has a good record under this Rule and has admitted the breach. He did say that however it was a Group 1 Race.

Reasons for Penalty:

The Committee considered the film evidence and submissions. Mr Purdon has admitted the breach but that was inevitable considering the compelling video evidence.

The Committee took the view that KAYLA MARIE was not giving Mr Purdon any difficulty and that it was an intentional act on his part. These were aggravating factors. The Committee also took into account the fact that this was a Group 1 Race and the stakes payable and this warranted a significant uplift in penalty. The Committee believes that a fine of $400 is more appropriate.
