Penalty:

Mr Jones' Licence to Ride is suspended from the conclusion of Racing on the 18th of July 2020 up to the conclusion of Racing on the 24th of July 2020. That is 2 National Riding days.

Facts:

Following the running of the PUKEKOHE COSSIE CLUB 1300 an Information was lodged by Stipendiary Steward Mr A Coles against Class B Rider Mr C Jones alleging that Mr Jones as the rider of DIOGENES permitted his mount to shift in near the 1100 metres mark when not sufficiently clear of MAGDALA which was checked.

Rule 638(1)(d) provides: A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Jones was present at the Hearing and he advised the Committee that he understood the rule and that he admitted the breach. Mr Jones was assisted by Mr N Harris.

Stipendiary Steward Mr B Jones demonstrated the incident by use of the race films. He showed where at the start Mr Callum Jones' horse had drawn out wide and soon after the start he allowed his horse to drift in when not sufficiently clear of MAGDALA. Inside that horse were SO MUCH MOUR and ALASKAN GOLD which both received resultant checks. He said that Mr C Jones allowed his horse to shift in one horse width and by use of the side on film he showed that DIOGENES  was not sufficiently clear of MAGDALA and as a result caused the interference.

Mr Harris said that the films showed that Mr Jones had made an error of Judgement and he also said that he was a very inexperienced Apprentice and had only been riding for two months.

Mr Jones has admitted the breach.

Submissions for Penalty:

Mr Coles referred to Mr Jones' position as an inexperienced Apprentice and also to the fact that he admitted the breach. He said that the incident was at the low end of the scale of seriousness.

He submitted that a two day suspension would be appropriate.

Mr Jones and Mr Harris agreed with Mr Coles' submission. When asked by the Committee Mr Jones asked for a deferment of any suspension until after the meeting at Te Rapa on the 18th of July 2020. 

Reasons for Penalty:

The race films show the incident very clearly. Mr Jones has admitted the breach and on the basis of the films he had no option.

The Committee takes the view that the incident is probably low range and Mr Jones' inexperience is taken into account.

These are also extraordinary times because of the Covid Pandemic and therefore there is a need to depart from the usual penalties that would be imposed under this Rule. A suspension of 2 riding days does seem to be appropriate.

Pursuant to Rule 1106(2) Mr Jones is granted a deferment of suspension until after the conclusion of racing on the 18th of July 2020.

The Timaru Racing Club Meeting on the 19th of July is not taken into account by the Committee when assessing the number of riding days involved in the suspension because Riders have already been declared for that meeting.
