Facts:

An Information was lodged by Stipendiary Steward Mr BJ Van Kan against Licensed Amateur Horseman Mr D Blakemore alleging that Mr Blakemore drove HORTON HEARS A WHO carelessly when trailing WITH A VENGEANCE (Driver Mr TR Vince) in that he struck the sulky wheel of WITH A VENGEANCE causing his horse to break with approximately 1300 metres to run.

Mr Blakemore was present and advised this Committee that he admitted the breach.

Mr Van Kan demonstrated the incident by use of the video films.

Submissions for Penalty:

Mr Van Kan said that this happened with approximately 1300 metres to run. He said that it was not a major incident of careless driving and that Mr Blakemore should be given credit for his good record and having admitted the breach.

He said that the starting point penalty was a fine of $250.00 but he would leave it to the Committee to decide.

Mr Blakemore for his part said that he had only had the horse for three starts and it was the first time that it was racing with blinds on and that he pulled hard. He said the horse was giving him some difficulties but he acknowledged that he should not have struck the wheel of the horse in front.

Reasons for Penalty:

The charge is admitted. The Committee has viewed the films and taken into account the submissions of the parties.

Mr Blakemore’s horse has not helped by racing ungenerously and the Committee views this matter as being at the lower end of the scale.

Mr Blakemore is given credit for his admission of breach, his good record and the fact that he is an Amateur Driver.
