We are thus satisfied that had interference not occurred HORSE OF COURSE would have finished ahead of STILL EYRE. We relegate STILL EYRE behind HORSE OF COURSE.
Amended placings are:

Facts:
Mr Tidmarsh, Stipendiary Steward, sought the relegation of STILL EYRE, placed 2nd by the Judge to behind HORSE OF COURSE, placed 3rd by the Judge in race 2 the DUNCAN AGRICULTURAL / OMAKAU AUTO CENTRE MOBILE TROT.
Rule 869A(2) provides:
When a placed horse or its driver causes interference to another placed horse and the Judicial Committee is satisfied that the horse interfered with would have finished ahead of the horse that, or whose driver, caused the interference the Judicial Committee must, in addition to any other penalty that may be imposed, place the horse that, or whose driver, caused the interference immediately after the horse interfered with.

Submissions for Decision:
Mr McIntyre, General Manager Stewards, demonstrated on the videos that HORSE OF COURSE was established in a run one back on the pylons to the inside of STILL EYRE. As the field entered the bend Mr Allen did not give sufficient room to HORSE OF COURSE and that horse galloped for some 110 metres. The horse caught the field and finished 3rd, 2¼ lengths behind STILL EYRE.
We viewed the videos and the back on video evidenced HORSE OF COURSE suffering interference from STILL EYRE at the 1500 metre mark.
Mr M Williamson, the driver of HORSE OF COURSE, gave evidence. He said he received pressure from his outside. He had tried to keep off the pylons but he had come into contact with them and this was “the sole reason HORSE OF COURSE broke”. He had been calling out yelling for room for some time prior to this. He believed the pressure from STILL EYRE was such that their carts were touching.
Mr Allen stated that there had been a lot of yelling from the start. His horse did lug down a little. He accepted he had placed pressure on HORSE OF COURSE.
When questioned, Mr Allen stated he did not contest the protest.
Reasons for Decision:
We find that STILL EYRE has interfered with HORSE OF COURSE by placing pressure on that horse and pushing it down on to pylons. HORSE OF COURSE broke and lost some 100 metres. It was thus quite some performance for that horse to finish within 2¼ lengths of STILL EYRE, which had not lost ground as a consequence of the incident.
