Facts:

Following the running of Race 1, The Bottle-O Mobile Pace, an Information was filed pursuant to Rule 869(2)(a). The informant, Mr Neal alleged that Mr Towers, the driver of “Righteous Royale”, used his whip excessively in the final straight.

Mr Towers acknowledged that he understood the rule, the charge and confirmed that he admitted the breach. Mr Towers also said that he understood the whip guidelines.

Rule 869(2)(a) reads:
No horseman shall during any race, use his whip in an unnecessary, excessive or improper manner.

Mr Neal identified Mr Towers and his horse Righteous Royale on the films. He said that in the run up the straight, Mr Towers had struck his horse 26 times with the whip, with only brief respites occurring.

Mr Towers agreed that he had hit his horse 26 times or thereabouts. He said that he is only a part-time driver and as his horse kept giving when being struck with the whip, he became a little excited. He added that his horse finished well for a close 4th.

Submissions for Penalty:

Mr Neal said that Mr Towers had a clean record insofar as the use of the whip was concerned, and submitted that similar breaches had been met with fines of $200.

Mr Towers for his part said that he would be happy with a fine that was less than $200, and as he was only a part-time driver, asked the committee to consider imposing a suspension.

Reasons for Penalty:

The committee took into account Mr Towers good record, admittance of the breach and the number of strikes (26 times). It was determined that to be consistent with other penalties for such a breach that a fine was the appropriate penalty.
