As Mr Oakden has admited the charge it is therefore deemed to be proved.
Penalty:
Mr Oakden is suspended from race riding from the conclusion of racing on Wednesday 10th August 2011 up until and including 30th September 2011.
Charge:
Alleged that D. Oakden failed to make the contract weight for "Morpheus" (Race 1) and "Cape Kinaveral" (Race 4).
Facts:
The Stipendiary Stewards were notified by Mr Oakden's employer prior to the start of the day's racing that Mr Oakden would be unable to make the weight that he had contracted to ride at in Races 1 and 4 on the day's programme. Mr Oakden had contracted to ride at 65 kg but found that he could not get his weight below 66.5 kg.
As a consequence Mr Oakden could not fulfil his engagements.
Mr Oakden was candid in his admissions to the hearing and said, in reponse to a question from the panel that he had been able to make his contracted weights on the first day of the Grand National meeting but for reasons unknown to him, he put on close to 3 kgs in the intervening period. He was distraught by this and advised the hearing that he intended to give up race riding.
Submissions for Penalty:
Mr Ray advised the hearing that Mr Oakden had appeared on 3 previous occasions before a Judicial Committee for a breach of this rule. He was fined on each occasion, with the most recent being on 4th August 2011 when he fined $400.
Mr Ray submitted that a suspension should be imposed on this occasion.
Mr Oakden had nothing to submit with regard to penalty.
Reasons for Penalty:
It is an aggravating feature that Mr Oakden has appeared on 3 previous occasions in the last twelve months for a breach of this rule. Because Mr Oakden has been fined on the previous occasions we take the view that a suspension is the only sentencing option in this case. Mr Oakden, by failing to make his contracted weight has let down the connections of the horses that he was to ride as well as the betting public. We do find any mitigating features.
