The protest is upheld and JACK RYAN is relegated from 1st to 2nd placing.

The amended placings are:

1st No 5 KERRI MAGUIRE
2nd No 3 JACK RYAN
3rd No 8 RUSSLEY RUSH
4th No 6 CHRISTIANSHAVTIME

The payment of dividends was authorised in accordance with this decision. 

Facts:

Following the running of Race 7 the Hydroflow Mobile Pace 2200m, Mr Muirhead instigated a protest into the 1st placed runner JACK RYAN alleging a breach of rule 870 (5) in that JACK RYAN galloped across the finish line and was lapped on by the 2nd placed horse KERRI MAGUIRE.

Rule 870 (5) reads:

Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finish line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869A) such relegation of the horse shall be at the discretion of the Judicial Committee.

Lapped on means when a horse has its nose in line with any part of the breaking horse’s body when the nose of the breaking horse reaches the finishing line.

Mr Telfer indicated on the information he did not contest the protest nor did he wish to be present at the hearing.

The provisional placings are:

1st No 3 JACK RYAN
2nd No 5 KERRI MAGUIRE
3rd No 8 RUSSLEY RUSH
4th No 6 CHRISTIANSHAVTIME

The official margins were ½ head between 1st and 2nd.  

Submissions for Decision:

Mr Mulcay demonstrated the final 100 metres of the race. He identified JACK RYAN who was racing on the outside of KERRI MAGUIRE. Both horses were vying for the lead. He stated that 20 metres from the finish JACK RYAN broke from its gait, free of interference, and galloped across the finish line in 1st place. KERRI MAGUIRE which finished in 2nd place was a nose behind at the line and was lapped on.

Mr Muirhead said Stewards were seeking the relegation of JACK RYAN from 1st place to 2nd place. He added that the connections of JACK RYAN did not contest the protest. 

Reasons for Decision:

On reviewing the video footage of the concluding stages of the race it was apparent that JACK RYAN broke and galloped free of interference and KERRY MAGUIRE was lapped on at the finish line.
