Mr Campbell admitted the breach and it is found proved.

Mr Campbell is suspended from the completion of racing on 26th April up to and including 5th May 2018 (7 days).

Facts:

Following the running of race 5 the Ray & Alison Kean of Southern Wide Real Estate, an Information was lodged alleging that Mr C Campbell was in a breach of r 638(1)(d) in that he “…permitted his mount “Dreaming Easy” to shift inwards when not sufficiently clear of “Starmaker” which was checked near the 900 metres.”

Rule 638 (1) (d) reads:

A rider shall not ride a horse in a manner which the Judicial Committee considers to be:

(d) careless.

Mr Campbell admitted the breach and appeared at the hearing assisted by Mr D Walsh – Jockey Mentor.

Mr Oatham, with the aid of the video replays, stated that "Dreaming Easy" was racing about four horse widths out approaching the bend. He said Mr Campbell shifted "Dreaming Easy" sideways and came into contact with "Starmaker" (S Collet). Miss Collett was forced to check her mount, which drifted back about a length. Mr Campbell had shifted his mount inwards on the point of the bend which was the wrong time to do so. He was not fully clear of Miss Collett when he shifted inwards. While he checked his mount immediately, contact had already been made.

Mr Walsh stated that Mr Campbell had shifted inwards a bit quicker than he expected.

Mr Campbell stated as he moved "Dreaming Easy" inwards she ducked in abruptly and made contact with "Starmaker".

Submissions for Penalty:

Mr Davidson stated this was Mr Campbell’s third breach of careless riding four months. He was suspended at Wingatui on 19th December (4 days) and again at Riccarton on 15th February (5 days). He was in his first season of riding and had over 200 rides to date and was a very busy apprentice rider. He had admitted the breach at the outset and cooperated fully with the stewards. He viewed the consequences of the interference as not high (Low – mid) and sought a suspension of 6 – 8 days.

Mr Walsh said while Mr Campbell had shifted inwards there was only minor interference to Miss Collett’s mount and it was clearly low range.

Mr Campbell stated he did not wish to seek a deferment of penalty.

Reasons for Penalty:

The aggravating features of this breach are that this is Mr Campbell’s third breach of the careless riding rule in four months, although on this occasion we view the breach at mid-level. We take an eight days suspension as a starting point. We give credit for Mr Campbell’s admission of the breach, that he fully cooperated with the stewards and is a busy apprentice jockey. We reduce the penalty by one day.
