As Ms Wenn has admitted the charge it is therefore found to be proved.

Penalty:

Ms Wenn is fined $350.

Facts:

In Race 6 of the Canterbury Jockey Club's meeting, the "NZ Bloodstock Warsteps Stakes", Ms Wenn was the rider of "Miss Alice" . Prior to the start a message had been sent to the barrier to remind all riders that there was prize money being paid for the first ten placings. Horses placed 6th to 10th were to be paid $1,000. Ms Wenn confirmed to the hearing that she heard that message.

Mr Zarb showed the hearing the video coverage of the finishing stages of the race, which showed how Ms Wenn with a least 20 metres to run (it could have been more but the camera angle did not show a greater distance back), effectively "stopped riding" by standing up in the stirrups. Just prior to that Ms Wenn had a reasonable chance of running into 10th position, She  did  not seem to take notice that "Angel Falls"  was making ground on Ms Wenn's mount. "Angel Falls" finished one half length ahead of "Miss Alice".

By way of explanation, Ms Wenn said that she felt that her horse was very tired as a result of the "Heavy11"  track conditions, and that she only stopped riding in the interests of the horse's welfare. She also said that she did not take a great deal of notice of the number of horses in front of her.

Submissions for Penalty:

Mr Zarb submitted to the hearing that a fine of $350 should be imposed, because only one week ago, Licensed Jockey W was fined that sum for a similar breach. In that case, Licensed Jockey W was also beaten for 10th position.

Ms Wenn said that she had an airfare to pay and that three of her mounts for the day's racing had been scratched. She thought that a fine of $350 was a "bit steep".

Reasons for Penalty:

Having considered the facts of the present case, and having had reference to the Penalty Data base, this committee considers that a fine of $350 must be imposed. Not only was Licensed Jockey W fined $350 only one week ago, but Licensed Jockeys M and J were fined the same amount in April 2012. In both of those cases, the horses were also beaten for 10th position.

There was nothing in the present instance to suggest that Ms Wenn should be treated any differently than the other jockeys who had been charged with a breach of the same rule.
