Mr Munro sought the disqualification of horse 6, IN SEQUENCE, placed 4th by the Judge as it galloped in excess of 50 metres in the final 200 metres.
Judge's placings were:
1st - 8 SMOKIN BANDAR
2nd - 10 AFTERBURNER
3rd - 1 HORSE OF COURSE
4th - 6 IN SEQUENCE
5th - 9 SPOTLIGHT THE VALLEY
Submissions for Decision:
Miss Haley demonstrated on the videos that IN SEQUENCE galloped for approximately 70 metres in the home straight.
Mr Hurrell after viewing the videos did not contest the protest.
Reasons for Decision:
After viewing the videos, the Committee is satisfied that IN SEQUENCE was not in its proper gait for a distance in excess of 50 metres in the final 200 metres. IN SEQUENCE was free of interference at the time. The Breaking Horse Regulations are clear in that the horse is deemed to be in breach of r 870(3) in that it has failed to promptly regain its proper gait.
