As the breach was admitted we find the charge proved.

Accordingly after taking all the above into account and under the provisions of 1106 (2) we impose a suspension of Ms Thornton's riding license which is to start after racing on 25 February and conclude after racing on 4 March 2013 (4 days).

Facts:
Following race 7 an information was filed pursuant to rule 638 (1) (d). Mr Coles alleged that near the 150 metres Ms Thornton permitted her mount BAGSAGOLD to shift out when not clear of BOWEN BOY which was dictated out into the line of STONELEIGH which was checked.
Submissions for Decision:
Mr Williamson demonstrated the relevant video films pointing out to the committee BAGSAGOLD racing adjacent to the running rail approaching the 200 metres. Shortly after this the films showed there was a gap available for STONELEIGH who was racing behind BAGSAGOLD and BOWEN BOY. Mr Williamson then showed Ms Thornton allowing her mount to move out approximately 2 horse widths when only half a length clear of BOWEN BOY. This caused BOWEN BOY to move out into the line of STONELEIGH who had to check.
Ms Thornton in admitting the breach, said her mount was hanging and she stopped riding on 2 occasions.
Submissions for Penalty:
Mr Coles produced Ms Thornton's record which showed 3 suspensions in the last 12 months. He said while Ms Thornton did not do enough to correct her mount she did put the whip away on 2 occasions and he submitted the breach was at the low end.
Ms Thornton said she had commitments until after 25 February and said that she had ridden in Invercargill last Saturday, 16 February and intended taking rides throughout the country.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. In mitigation Ms Thornton has a good record and she has admitted the breach. However 2 horses were effected by Ms Thornton moving out 2 horse widths when insufficiently clear with STONELEIGH receiving a check at a critical stage of the race.
On questioning Ms Thornton as to where she intended riding in the near future she could not confirm she had any engagements at Omakau on 1 March. Therefore this meeting was not taken into account when assessing penalty. However the committee independently assesses today's breach at the low end and concludes a 4 day penalty is appropriate.
