Facts:

N. Quinn admitted a breach of rule 638 (3) (b) in that he used his whip in an excessive manner in the home straight on the winner ‘Little Benny’.

Rule 638 (3) (b) reads:

A rider shall not strike a horse with a whip in a manner or to an extent which is excessive.

Mr. Goodwin, using the available films, showed the sequence of the charge where the stewards alledged that the horse ‘Little Benny’ was struck with the whip outside the guidelines. Mr. Goodwin believed the horse was struck with the whip 13 times before the 200 metre mark. The guidelines of striking 6 times and putting the whip away for 6 strides was not adhered to. Mr. Quinn understood the rule but indicated while the guidelines were breached, his striking of the horse was not continuous.

Submissions for Penalty:

Mr. Goodwin, while accepting that this was Mr. Quinn's first charge under the rule, asked for a monetary penalty of in excess of $200. He asked the committee to take into account that Mr. Quinn's mount did win the race, and may have gained an advantage.

Mr. Quinn had little comment, he asked the committee to consider that this was his first charge and his winning percentage for his first flat win was not all that great.

Reasons for Penalty:

The committee in accepting that a monetary penalty be imposed, took into account that this was Mr. Quinn's first winning ride on the flat and that this was his first breach of the rule.

A quick perusal of the penalty guidelines indicated first breaches of this rule resulted in penalties of approximately $200.00. The committee believed a slight reduction of that figure should be considered in this case because of admittance of the breach and that the severity of breach was considered to be at the lower end.
