As Mr Hunter admitted the breach we find the charge proved.

Mr Hunter is fined the sum of $400 and warned that a suspension is the likely outcome should he breach the rule again this season.
Charge:
Mr Allison, stipendiary steward, alleged that Mr Hunter used his whip excessively when driving out FRANCO LEDGER over the final stages of race 8.
Facts:
Mr Allison demonstrated on the videos that FRANCO LEDGER was sitting parked for the last 1000 metres of the race and in the run home the respondent used his whip on the horse some 24 to 25 times.

Mr Allison acknowledged there was one break in the whip action about 100 metres out and that there was also a dummy strike. He said as a general guide any more than 20 strikes would be questioned by the stewards.
Mr Hunter said that Mr Allison’s description was “fair” and that he was simply endeavouring to get the best out of his horse, which had come close to winning, and emphasised it was a Group 3 race with a $30,000 stake.

Mr Allison stated that the breach was not high range and was best viewed as at the lower end of mid range. He acknowledged it was a tight finish but Mr Hunter had not broken the strikes up sufficiently. He produced the respondent’s record, which evidenced 2 previous breaches of the rule this past year. He submitted a fine of $350 was appropriate.
Mr Hunter reiterated it was a Group 3 race and that he was doing the best for the horse and its connections.
Reasons for Penalty:
We are satisfied that there were at least 25 strikes with the whip. Indeed we believe this count may be generous to Mr Hunter. Many of the strikes are quite forceful. We accept there was one break but 25 strikes is simply far too many. The fact it is a Group 3 race with good stakes is no excuse for breaching the rule. We are concerned that this is the respondent’s 3rd breach in the space of a year. The penalty needs to contain an element of specific deterrence.
