Mr Shaikh has admitted the breach, which we find proved.

Penalty:

The penalty is thus a 2-day suspension. Mr Shaikh is suspended from the end of the period of suspension imposed earlier today up to and including 21 January. This is two South Island days (Kumara 14 January and Gore 21 January). Mr Shaikh is reminded of his professional obligations.

Facts:

Mr Davidson alleged that Mr P Shaikh (ALLAQUILA) allowed his mount to shift inwards near the 650 metres causing LIN (Mr G Jogoo) to be checked.

Mr Davidson demonstrated on the video that near the 650 metres at the end of the back straight the respondent was racing 3 wide. He gave his horse a slap to go forward. ALLAQUILA stepped in and LIN had to check off his heels.

Mr Pitman stated that ALLAQUILA had rolled in very quickly and Mr Shaikh had tried to pull the horse off.

Mr Shaikh said he was trying to go forward on the bend. He had slapped up ALLAQUILA and it had stepped in very quickly. He emphasised he had no intention of shifting in. By the time he had pulled the reins up the horse was “already there”.

Submissions for Penalty:

Mr Davidson submitted the breach was low end and a penalty at the low end was appropriate.

Mr Pitman emphasised the shortage of South Island jockeys at the present time. He submitted that a fine be substituted for part of the suspension in order to permit the respondent to ride in the Gore Guineas.

Reasons for Penalty:

We take the 3-day South Island starting point. We reduce this by one day for the low-end nature of the breach. Mr Shaikh carelessness was in the fact he should have had better control of ALLAQUILA and his obligation was to keep out. Ms Wynne, who was racing to the inside of Mr Jogoo, had anticipated the crowding, and had to steady her horse. Mr Jogoo had to change ground and has gone to the outside of ALLAQUILA. Ms Wynne was thus able to maintain her running line.

We have considered carefully whether to increase the starting point by one day as this is the second time Mr Shaikh has appeared before us today. Both breaches of the careless riding rule have been low end. Mr Davidson has acknowledged that the rider of LIN had to check his mount but the check was not severe. Mr Shaikh’s record prior to today had been very good. His previous breach was six months ago, and he is a busy South Island apprentice.

We have had regard to the scarcity of South Island jockeys at present, but we are unable to accommodate Mr Pitman’s request that the respondent be able to ride at Gore. A penalty of one day’s suspension and a fine is simply not appropriate. We have regard to the frequency of meetings in the South Island after the West Coast circuit. Any uplift for record we believe is balanced by the respondent’s ready admission of the breach.
