Facts:

Mr Jones was charged with a breach of r 869(2) and clause (b) of the Whip Regulations following race 4 the Glamour Hooves Racing Stables Fillies & Mares Pace, at the Kurow TC meeting on the 18th August 2019. The Information alleged Mr Jones…”used his whip more times than is permitted under Clause (b) of the use of the Whip Regulations, inside the final 400m.”

Rule 869 (2) reads:

No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.

Whip Regulation (b) reads:

No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Following consultation with a senior horseman Mr Jones admitted the charge and appeared at the hearing.

Mr Quirk, with the aid of the video replays, stated that Mr Jones (AMORE LANCOME) was racing outside the leader approaching the final straight to the finish. He was observed to use his whip about 13 times from that point to the finish.

Mr Jones stated he had got carried away. He said his use of the whip was low range.

Submissions for Penalty:

Mr Quirk said Mr Jones had 126 drives lifetime, 27 last season and had had 3 this season. He had no previous charges under the rule. He sought a fine of $200 as per the scale set down in the penalty guide.

Mr Jones accepted the stewards' submission.

Reasons for Penalty:

Clause (b) of the Whip Regulations sets a fixed penalty depending on the number of strikes with the whip. While Mr Jones admitted the breach at the outset we see no need to increase or lower the penalty submission of the stewards.
