Facts:
Following Race 1 (Novus Auto Glass Napier Mile), Mr Goodwin lodged an Information with the Judicial Committee alleging a breach of Rule 638(3)(b)(ii) in that D Bradley used his whip excessively on POP “N” ROCK prior to the 100metres.
A Rider shall not:
(ii) strike a horse with a whip in a manner or to an extent which is excessive
The “Guidelines with Respect to Acceptable Use of the Whip” provide:
Without affecting the generality of Rule 638(3) (b) a rider may be penalised if their whip use is outside of the following guidelines:
Inside the final 600 metres of any Race, official trial or jump-out a horse may be struck with the drawn whip up to five times after which the rider must cease their use of the whip for a minimum of five strides before striking the horse again with the drawn whip, with this restriction to apply prior to the final 100 metres. The whip may then be used at the rider’s discretion until the winning post is reached.
Prior to the final 600 metres of a race, official trial or jump-out the use of the drawn whip is acceptable if used in moderation and not continually.
Mr Goodwin had Mr Jones demonstrate the breach using the videos. He showed Mr Bradley in a three-wide position approaching the home turn when he drew his whip and hit his horse 13 times without the required respite. Mr Bradley said it was clear that his use of the whip sat outside of the guidelines.

Mr Goodwin said this was Mr Bradley’s first excessive use of the whip charge since new guidelines were introduced last year. He said Mr Bradley was a kind rider who did not usually overuse the whip and submitted that a penalty in line with the guidelines be imposed.
Mr Bradley explained his whip use saying that his horse was “off the bridle” and he was just trying to get it going.

3rd or subsequent breach 6-8 national riding days
Mr Bradley struck his mount a total of 13 times but not in a continuous manner. There were six initial strikes, three strides respite, followed by a further seven strikes. The Committee was satisfied that this sat at the low end of excessive whip use. Taking into account this was Mr Bradley’s first breach of the rule we adopted a $300 fine starting point. There were no aggravating factors that would require an uplift from the starting point.
