As Mr Singh admitted the breach the Committee found the charge proved.

Penalty:

The Committee grant a deferment to Mr Singh’s suspension pursuant to Rule 1106(2).

Accordingly, Mr Singh had his license to ride in races suspended for a period to commence after racing on 28 October and conclude after racing on 9 November 2017 (3 riding days).

That period of suspension encompasses meetings at

3 November – New Plymouth

4 November – Palmerston North

9 November – Otaki

Facts:

Following the running of race 1, BCD Group 2100, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that near the 100 metres Mr Singh allowed his mount GOBSTOPPER to shift outwards when not sufficiently clear of THORN PASS which was checked.

Mr Singh acknowledged that he understood the Rule and confirmed his admission of the breach. Mr Harris assisted Mr Singh at the hearing.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Williamson used the available video footage to demonstrate the incident. He identified that near the 100 metres Mr Singh commenced to use his whip on his mount and it shifted out into the rightful running line of THORN PASS who was checked. He said that Mr Singh was only 1 length clear of that runner and Mr Singh failed to take any corrective action.

Mr Singh acknowledged that he drifted out when insufficiently clear and checked THORN PASS.

Mr Harris identified that there was too much stick used and that Mr Singh was too late in taking any corrective action. Mr Harris told the Committee that there has been no Riding Master in the Central Districts for over 2 months. He believed that this was having an impact on the Apprentice riders in that region.

Submissions for Penalty:

Mr Oatham produced Mr Singh’s record which showed 1 previous breach under this Rule which occurred on this date last year. He said this was a relatively good record and today’s incident was at the low end of the scale. Mr Oatham said an appropriate penalty would be a suspension and that would be 3 days in the Central Region. He added that Mr Singh predominately rode in that region.

Mr Singh advised the Committee that he had engagements up to and including 28th of October and sought a deferment to fulfil those engagements.

Mr Singh and Mr Harris had nothing further to add.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Penalty Guide for Judicial Committees recommends that the starting point for careless riding is a 5 day suspension.

There were no aggravating factors.

The mitigating factors were Mr Singh’s admission of the breach, his good record and the level of carelessness was in the low range. For these collective factors Mr Singh was afforded a reduction of 2 days.

The RIU records showed that Mr Singh has no recent history of riding in the Northern and Southern regions.

After taking into account all the above factors the Committee considered an appropriate suspension was 3 riding days.
