Mr Court admitted the breach, which we thus find proved.

Penalty:

Having regard to the respondent’s excellent record in respect of this rule and his admission of the breach we impose a suspension of 2 South Island days, which encompasses the premier meeting at Addington.

Mr Court is suspended at the end of racing on Sunday 29 January up to and including 4 February 2012.

Charge:

Mr Allison, stipendiary steward, alleged that Mr P Court (BETWEEN THE LINES) started from the incorrect barrier position of 2 on the second line instead of the unruly 1 position.

Facts:

Mr Allison demonstrated on the videos that BETWEEN THE LINES had started on the second line just behind the 2 and 3 horses, whereas he should have been behind the horse that had drawn 5.

Mr Court explained that he had initially come in behind the mobile in a position wider on the track but due to the atrocious weather conditions and his horse hanging he had shifted in as the mobile rounded the bend before the start.

Submissions for Penalty:

Mr Allison produced the respondent’s record, which was clear under this rule. He submitted that the starting point recommended in the Penalty Guide of 8 drives or $400 was not appropriate on this occasion due to the adverse weather conditions on the night. However, he emphasised as a senior horseman the respondent should have been well aware of what his obligations were in respect of this rule. He submitted a fine of $200 to $250 was appropriate.

Mr Court explained he had a young family and asked this committee to consider the imposition of a period of suspension. Mr Allison responded that if the committee were so inclined, a 2 or 3 day suspension was appropriate.

Reasons for Penalty:

The respondent is fortunate that his horse was not disqualified. The issue as to whether BETWEEN THE LINES had obtained an advantage from starting in an incorrect barrier position was a close decision, which ultimately went in the horse’s favour. Mr Court can obtain no credit for this, but on the other hand there was no disqualification of the horse, which would naturally have impacted on our assessment of the gravity of the charge. The adverse weather conditions on the night also influence our decision as to penalty.
