Charge:
An information was lodged by Stipendiary Steward Mr S Renault following the running of race 8 alleging that Mr J W Cox driving the horse (Flying Diamonds) has failed to come up into his barrier position.
Facts:
Mr Renault used video film to demonstrate the incident. Mr Renault stated that Mr Cox who was driving the horse Flying Diamonds and who was drawn five on the front line failed to maintain the correct position on the starting gate drifting approximately one and a half lengths from the barrier arm at the point of dispatch.
Mr Cox whilst having admitted the breach stated that he had mistaken the one thousand metre marker to be the starting point and told the Committee he had made an error of judgement.
Submissions for Penalty:
Mr Renault stated that Mr Cox was an experienced horseman, having had four hundred and three drives last season and seventy one drives this current season.
Mr Cox gave no submissions on penalty.

In deciding the penalty the Committee takes into account the following:
1. Mr Cox's admission.
2. The fact that Mr Cox had no previous breaches under this rule in the past twelve months.
