Accordingly, Mr Dunn is fined $200.

Facts:

Following the running of Race 8, an Information was filed by Stipendiary Steward, Mr S Renault, against Open Driver Mr J Dunn alleging that “Mr Dunn drove carelessly near the 500M when allowing his runner to strike the wheel of FRANCO NIVEN resulting in his horse breaking briefly and losing ground”.

Mr Dunn signed the Information admitting the breach, and he understood the rule. Mr Dunn was excused by the Committee from attending the hearing as he had his team loading for their trip home and he was driving in the upcoming last race.

Rule 869(3) (b) provides as follows:

(3) no horseman in any race shall drive:
(b) carelessly

Mr Renault used the race video to identify Mr Dunn driving JAY TEE TYRON at approximately the 500 metre mark. He showed a close-up slow motion shot of JAY TEE TYRON’S off side hoof strike a wheel, recoil back, causing him to immediately gallop losing a length and a half.

Submissions for Penalty:

Mr Renault said a fine was appropriate in this instance. He said JAY TEE TYRON had been a little erratic to drive and this combined with Mr Dunn’s excellent record a fine of $200 would be appropriate.

Reasons for Penalty:

The JCA Penalty Guidelines for the rule provides a starting point of a $300 fine or a 6-drive suspension any time a driver hits a wheel. This Committee assess this to be a clear case of careless driving and a fine is appropriate.

The mitigating factors are Mr Dunn’s admission of the breach.

The consequences of the horse losing a length or two had no bearing on its final placing.

Mr Dunn was having his 825th drive within this season and the last, without a breach of any rule, a remarkable effort.

There are no aggravating factors to consider.

The Committee having regard for the above factors, considered a $200 fine as an appropriate penalty in this case.
