Facts:
Following the running of Race 5, the LOVERIDGE HOME KILL TROT, an Information instigating a protest was filed by Stipendiary Steward Mr C Allison, alleging interference approximately 200m from the finish by the 1st and 2nd placed horses Chiola Belle and Starlight Invasion respectively against the fifth placed runner Swept Away.
The Judge's placings in this race were as follows:

Rule 869(8) provides as follows:
“The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, -
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.
Submissions for Decision:
Mr Allison stated that approaching the 200m mark Chiola Belle (JW Cox), when leading, shifted outwards approx. ½ cart width causing crowding to Swept Away. At the same time Starlight Invasion (SP Walkinshaw) which was improving three wide outside Swept Away (R McIlwrick) ducked inwards with its inside sulky wheel coming into contact with the back foot of Swept Away causing it to break. Mr Allison was seeking the relegation of both Chiola Belle and Starlight Invasion to behind Swept Away.
Mr McIlwrick stated his horse had broken as a result of Chiola Belle shifted ground in front of him and Starlight Invasion’s sulky wheel coming into contact with his horse. The crowding by Chiola Belle had created a claustrophobic situation for his horse. He also stated he wasn’t travelling that well at the point and did not believe he would have finished in a better position.
Mr Cox stated his horse had rolled outwards ½ a cart width, but did not interfere with Swept Away. He pointed out on the video replays that his horse was well clear of Swept Away at the time that horse broke.
Mr Walkinshaw stated his horse had ducked in and had made contact with Starlight Invasion. However he believed Starlight Invasion had shifted outwards slightly due to Chiola Belle moving outwards at the same time.
Neither Mr Williamson nor Mr McLachlan had any new evidence to contribute.
In his summary Mr Allison withdrew his protest against the 1st placed Chiola Belle. However, he believed Swept Away would have finished in a better position had there not been interference from Starlight Invasion.
Reasons for Decision:
The video evidence clearly shows that Swept Away broke as a result of Starlight Invasion shifting inwards causing interference. There is no video evidence to show that Swept Away contributed to the incident by shifting ground outwards, either on its own account or the result of crowding by Chiola Belle. At the point of the interference Swept Away was on equal terms with both Starlight Invasion on its outer and Sure Sign on its inner.
We find that the chances of Swept Away finishing in a better position were affected by the interference from Starlight Invasion and the protest against 2nd placing to Starlight Invasion is upheld.
