As the charge was admitted it was found to be proved by the Judicial Committee.

Penalty:

Ms Goodinson was fined $400.

Facts:

Following the running of Race 2 (Mills Reef Winery Jumpers Flat) Information No. A8760 was filed with the Judicial Committee. It was alleged that Ms Goodinson, the rider of THATZ DAVID used her whip excessively prior to the 200m without the necessary respite.

Rule 638(3)(b)(ii) provides:
A rider shall not: strike a horse with a whip in a manner or to an extent which is: excessive.

Ms Goodinson acknowledged that she understood the Rule, Charge, the Whip Guidelines and confirmed that she admitted the breach.

Mr Balcombe showed all film replays, identified Ms Goodinson and her mount as being in the lead entering the final straight. He said that Ms Goodinson then hit her horse 13 times with the whip prior to the 200m.

Mr Goodwin said that Ms Goodinson had hit her horse 13 times without the necessary respite before the 200m. he said that she did give breaks but only for 3 strides. (Guidelines state that breaks must be for 6 strides after 6 strikes of the whip).

Mr Goodinson said that she agreed with the Stipendiary Stewards interpretation of her whip use. She said that she made a mistake and clearly could not count. She added that her horse did cruise on at the finish following the whip use.

Submissions for Penalty:

Mr Goodwin produced Ms Goodinson’s record which showed that the last time Ms Goodinson had breached the Whip Rule was on 3 July 2016 with a fine of $300 being imposed. He said that an aggravating factor was that the horse went on and won the race. He submitted that the Committee consider imposing a suspension, or, if a fine was to be imposed, that it not be less than the starting point of $500.

Ms Goodinson in response said that she preferred that a fine be imposed by the committee.

Reasons for Penalty:

In fixing penalty the following matters were given due consideration:

- Admittance of the breach

- Albeit the last breach was in July 2016, the record showed that Ms Goodinson had had only approximately 6 raceday rides since that date

- The number of strides (13) with only brief respites

- The JCA starting point of $500

- The penalty submissions

It was determined by the Committee that a fine of $400 be imposed.
