Facts:
After the running of Race 1 the Buteline NZ LTD Trot an Information A13959 was lodged by Stipendiary Steward Miss R Haley alleging Mr B Norman (Clover Jewel) drove carelessly.
The Stewards alleging that racing into the first bend Clover Jewel shifted inwards when insufficiently clear of Tinted Stuart (M Heenan) which was checked and broke.
Mr B Norman admitted the charge, appeared at the hearing, and confirmed he understood the Rule.
The Rule reads 869 (3) (B):
No driver should drive (Carelessly).
Mr Renault (Stipendiary Steward) used several video clips of the alleged incident, highlighting Tease My Tartan leading (B Orange) with Clover Jewel (B Norman) racing on the outside, then attempting to move down into the trailing position when insufficiently clear.
Mr Renault also highlighted Mr Heenan taking a hold of Tinted Stuart with the horse being checked and breaking. Mr Renault confirmed no contact had been made between the two horses.
Mr Norman confirmed Mr Renault’s summation.

Miss Haley said Mr Norman had 3884 Lifetime Drives, 34 last season and 27 this season. His record was excellent, and he had admitted the breach.
Miss Haley confirmed Mr Norman had one to two race day drives locally on occasion.
Mr Norman stated he had been using Mr B Orange to drive his horses if he was travelling South.
Mr Norman did not seek a deferment.
Miss Haley stated the range of carelessness was low to mid and the JCA Penalty Guide recommended a 10-drive suspension under this Rule.

After considering submissions the Committee took into account Mr Norman’s excellent driving record and his admittance of the breach and gave him credit.
A suspension at the middle of the scale is appropriate.
