Mr J Robinson being the driver of Noblesse Royale failed to maintain his position on the mobile gate at the start of race 5.

Facts:

Stipendiary Steward Mr T W Taumanu lodged an information alleging a breach of Rule 857(7)(g) by Mr Robinson at the start of Race 5.

Mr Robinson appeared for the hearing and endorsed the information admitting the breach.

Mr Taumanu  showed the hearing footage of the start of the race and identified Mr Robinson driving Noblesse Royale behind the mobile barrier drawn 6.  At  the start Noblesse Royale was approximately one and a half lengths away from the barrier arm.

Mr Robinson conceded that he was not in the correct position and said he had been bluffed by the horse on his inside.  He thought the race had already started and had been on the mobile immediately prior to the race starting   

Submissions for Decision:

Mr Taumanu told the committee that Mr Robinson was a very experienced driver and should be given credit for his admission of guilt.

He had no history of similar breaches and the breach was in the middle to upper range.  The guidelines indicated a starting point of $250.00 fine

Mr Robinson considered the fine sought was fair.
