This Committee suspends Miss Newman's Riders Licence from the conclusion of racing on the 12th of December 2020 up to the conclusion of racing on the 18th of December 2020. That is 3 National Riding days being Counties, Ashburton and Otaki. In addition Miss Newman is fined the sum of $250.00.
Facts:
Following the running of the SHOWTECHNIX 1200 an Information was lodged by Stipendiary Steward Mr B Jones against Apprentice Jockey Miss T Newman alleging that Miss Newman as the Rider of LUNA VAARA allowed her mount to shift in at about the 950 metres mark when not clear of LET'S DO THIS (Rider S McKay) which was checked.
Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Miss Newman was present at the hearing and she acknowledged that she understood the Rule and that she admitted the breach. Miss Newman was assisted by Apprentice Jockey Mentor Mr N G Harris.
Stipendiary Steward Mr A Coles demonstrated the incident by use of the race films. He identified Miss Newman's and Mr McKay's horses and showed where at about the 950 metres mark Miss Newman was outside Mr McKay and moving forward. He showed that when she was ahead of Mr McKay's horse she shifted her horse inwards and in doing so caused a check to LET'S DO THIS.
Using the side on film he showed where Miss Newman was perhaps a length to a length and a quarter clear of Mr McKay's horse but certainly not the required distance.
Miss Newman said that prior to the incident she looked over at Mr McKay a couple of times and he appeared to be taking hold of his horse. She then thought that she had enough room to move in in front of him but he hadn't eased back far enough.
Mr Harris said that Miss Newman had misjudged the distance and if she had waited a stride or two longer she would have been fine.
Submissions for Penalty:
Mr Jones said that Miss Newman had one breach of this Rule in the last 12 months and that was at Te Rapa on the 5th of September for which she received a 4 day suspension. He submitted that the incident was at the low range of seriousness and it appeared to be a simple mistake on Miss Newman's part.
Mr Harris said that the incident was certainly low range and a misjudgement on Miss Newman's part.
He said that Miss Newman should be given credit for her good record because she is quite a busy Jockey.
Mr Jones said that Miss Newman had had over 220 rides in the last 12 months and she has ridden 124 times since the charge in September.
Reasons for Penalty:
The incident is clearly shown on the race films and in the Committee's opinion it is at the very low end of seriousness. The films support Miss Newman's evidence and she can be seen looking over 2 or 3 times at Mr McKay and appears to be taking proper precautions but she moved in too soon and Mr McKay's horse was checked. It was a gentle inwards movement and Mr McKay's chances, in our view, were not greatly affected.
Miss Newman has not seen the new Penalty Guidelines until now.
The starting point penalty for low range carelessness is a suspension of 4 days but because of her good record we reduce that by one day. In addition we are required to impose a fine of $250.00 on Miss Newman and accordingly do so.
Miss Newman was asked if she wanted a deferment of the suspension but she wants to start it straight away. That will be after the Te Rapa meeting on the 12th of December for which Riders are already declared.
