As Mr Grylls admitted the breach the Committee find the charge proved.

Penalty:

The Committee grant Mr Grylls' request to seek a deferment to his suspension as per Rule 1106(2).

Accordingly, Mr Grylls had his license to ride in races suspended for a period to commence after racing on 28 November and conclude after racing on 5 December (3 North Island days).

Facts:

Following the running of race 7, Te Aroha Supporters Club 1200, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Grylls permitted his mount ALL THE RAAJ to shift outwards when not sufficiently clear of NIPABRANDY which was checked near the 225 metres.

Mr Grylls acknowledged that he understood the Rule and confirmed his admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Coles demonstrated the incident on the available video footage. He identified that passing the 250 metres Mr Grylls was awkwardly placed on the heels of ALMIGHTY SUN. He said Mr Grylls made an error of judgement when shifting ground outwards when only a bare length clear which resulted in NIPABRANDY being checked.

Mr Grylls acknowledged that it is a lack of judgement on his part. He believed the incident is exaggerated due to ALMIGHTY SUN shifting in at the same time he shifted outwards.

Submissions for Penalty:

Mr Williamson produced Mr Grylls' record which showed 1 previous breach in the last 12 months this being in January. He said this is an outstanding record and described the interference as not of the highest end. He submitted a suspension at the low end.

Mr Grylls advised that he had upcoming engagements at Ellerslie on 28 November, and sought a deferment to any proposed suspension. He said the interference is very minor.

Mr Grylls submitted that he rode all over the North Island advising he recently rode at Hastings on an Industry day. Mr Grylls is forthright in that he had no intention of riding at any upcoming South Island meetings.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Committee have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors are Mr Grylls' admission of the breach, the level of carelessness is low end and it is 11 months since his last breach of this rule which is a very good record. These significant mitigating factors justify a 2 day discount.

The Committee is satisfied that Mr Grylls has a recent history of riding in the Central Districts on an Industry day.

After taking into account all the above factors the Committee considers an appropriate suspension is 3 days.
