Facts:
Following the running of Race 3 (COLIN BREMNER 1200m) Information A9237 was filed with the Judicial Committee. It alleged a breach of Rule 638(1)(d) and stated that: ”...Darryl Bradley (ETERNAL) allowed his mount to shift inwards near the 250m when not clear of HEART OF FAME which was checked.”
Rule 638(1)(d) states:
“A Rider shall not ride a horse in a manner which the Judicial Committee considers to be: … (d) careless.”
Mr D Bradley indicated to the committee that he understood Rule 638 (1)(d), and that he did admit the breach. Using the available head-on and side-on films, Mr Goodwin identified Mr Bradley trailing the leader and riding with some vigour passing the 300m. He had allowed his mount to shift inwards over some distance, and in doing so caused a check to Mr Singh (HEART OF FAME), who was positioned on his inside, closer to the rail. It was the stewards’ contention that Mr Bradley did not do enough whilst he was on an inwards path, and it was expected that he would straighten much sooner than he had.
Mr Bradley concurred with the view of the stewards, accepting that he was late in correcting his mount. He used the head-on film to demonstrate that he was following the leader (MASTER BEN), which was also rolling inwards, and that there was no way that he could prevent his horse moving inwards as he had been dictated by MASTER BEN. Under questioning from the Committee, Mr Bradley agreed that his horse had followed MASTER BEN, rather than being dictated by that gelding. He said that it was ETERNAL’s first start and while a gap had been presented to his outside, the horse had been too inexperienced to take it. He believed the whole incident was abrupt in nature and that he was simply one stride too late and a victim of circumstance.

In presenting Mr Bradley’s record, Mr Balcombe identified two previous breaches of the rule: Wairarapa RC on 6 February (8 Days) and Taranaki TI on 21 July (8 Days). He submitted that the level of carelessness was slightly below mid-range as he had moved inwards for three to four strides under heavy riding, causing a significant check to Mr Singh.
Mr Bradley identified that his suspension on 6 February incorporated the fact that that concerned a Listed Race, and he therefore submitted that he had a good record. He advised that any period of suspension could commence after racing on Saturday 29 September 2018.
Reasons for Penalty:
The Committee considered all of the submissions placed before it. It is clear from the films that Mr Bradley continued to move inwards whilst passing the 300m. He did so abruptly which meant he was not able to take the corrective action that he should have at the time. If he did so, the resultant check to Mr Singh would not have occured. Even though this was the first raceday start for his mount, as an experienced rider, he should have straightened ETERNAL much sooner in order to take the gap that he had originally wanted to take. On this occasion he was simply one stride too late at a time when runners were balancing up in the run to the line. Based on our assessment we place the level of carelessness at below mid-range and adopted a starting point of a seven day period of suspension. In mitigation we have considered his record and his admission of the breach. The end result is a six day period of suspension.
