Mr Turner has admitted the breach. We thus find the breach is proved.
Penalty:
Mr Turner was fined the sum of $300 and was told that further weight breaches in the near future were likely to be met with suspensions. He acknowledged that he understood this.
Facts:
Mr Davidson alleged that Mr Turner failed to make contract weight for AMOUR LA VIE (race 5) and FRIAR TUCK (race 6), both of which had 54 kg.
Rule 330(3)(c) provides: “A Rider shall not fail to ride a horse at the weight at which it is handicapped to carry.”
Mr Davidson stated that prior to race 2 Mr Turner had come to the Stewards and had said he was struggling with the last 1/2 kg. He was carded to ride at 54 kg and he could get to 55 kg but not to 54.5 kg.
Mr Turner said that he had had weight issues since a recent suspension. He said he had been wasting during the week and had lost 3 or 4 kg. He had 3 lengthy showers prior to going to the Stewards but had not been able to lose the 1/2 kg. His flights had been delayed and there was no sauna on course.

Mr Davidson produced the respondent’s record. This was Mr Turner’s third breach in four months. He emphasised that Mr Turner only missed the reset period by some 9 days. Mr Turner had been fined $100 on 1 January and $200 on 30 January. Mr Davidson submitted a fine in excess of $200 was appropriate.
Mr Turner said he rode throughout New Zealand and asked us to take into account that he was only a few days away from the reset.

Mr Turner has failed to make his carded weight for two horses. We accept he has made every endeavour to lose the necessary last 1/2 kg but has been unable to do so. As both parties have emphasised in their submissions, he was close to the reset period.
We accept Mr Davidson’s submission that the fine should be in excess of $200 and, having regard to the need for deterrence, we believe a fine of $300 is appropriate.
