Mr Teeluck was suspended from race riding from after the completion of racing on Saturday 31 October until the completion of racing on Thursday 12 November (4 days).

Facts:

Following the completion of race 9 at Woodville, Shires Fruit and Vege Market Mile Apprentice Jockey N Teeluck was charged under rule 638 (1) (d) in that he permitted his mount MWAADAN to shift inwards near the 1100 metres when not the required distance clear of O'REN ISHI (L Werner) which was checked.

Rule 638 (1) (d) reads:  A rider shall not ride a horse in a manner the judicial committee considers to be careless.

Submissions for Decision:

After confirming Mr Teeluck did not admit the breach Mr Goodwin called jockey L Werner as a witness. She confirmed she rode O'REN ISHI and that running down the back straight the horse MWAADAN ridden by N Teeluck drifted across on to her mount down on the rails. The drifting caused her to take hold and she was checked. She confirmed that Mr Teeluck was not fully in front and that his mount continued to drift on to hers. She did suffer pressure.

Neither Mr Teeluck or Mrs Zimmerman had any questions.

Mr Goodwin submitted that prior to the movement inwards Mr Teeluck looked across at Miss Werner. His horse rolled inwards causing Miss Werner to take hold. He informed the committee there was no other pressure from other horses and that Miss Goldsbury, travelling on Mr Teeluck's outside did not, in his opinion, contribute to the incident. Miss Werner, he submitted, was entitled to be where she was. He was adamant that Mr Teeluck was not the required distance clear when he drifted across. All available films were shown and neither Mr Teeluck or Mrs Zimmerman had any questions.

Mr Teeluck submitted that he believed there was pressure on his mount from Miss Goldsbury on his outside. He confirmed that he did drift inwards onto Miss Werner's mount. He thought that initially he was sufficiently clear. Under question and after viewing the films he confirmed he was not the required distance clear.

Miss Goldsbury was then called to give evidence because of Mr Teeluck's belief her movement contributed to the incident. As the rider of GEM TWIST Miss Goldsbury confirmed she was travelling on Mr Teeluck's outside. She believed she suffered no pressure in the incident and did not contribute to it at all even though she did move inwards slightly.

Mrs Zimmerman informed the committee she believed the outside movement of Miss Goldsbury's mount from 3 wide to 2 wide was a contributing factor in the incident.

Mr Goodwin reiterated it was his belief that the slight inward movement of Miss Goldsbury's mount did not contribute to the incident. Mr Teeluck had already allowed his mount to drift inwards onto Miss Werner's mount. He believed that Mr Teeluck was not the required distance clear when he commenced his inward movement.

Reasons for Decision:

The films, especially the head on, clearly showed Mr Teeluck's movement inward onto Miss Werner's mount when he was not the required distance clear. The committee was of the opinion that Miss Goldsbury's actions in no way contributed to the incident. Miss Werner had to take hold of her mount and she was entitled to be where she was.

Submissions for Penalty:

Mr Goodwin informed the committee that Mr Teeluck had been suspended under this rule three times during the season.

He believed the offence to be at the lower end of the scale and asked for a period of suspension to be imposed.

Mr Teeluck had little to add asking for any penalty that may be imposed to begin after racing on Saturday 31 October.

Reasons for Penalty:

In coming to its decision the committee was mindful of the degree of carelessness which was in the low range. Mr Teeluck is mainly a Central Districts rider who has recently started to obtain more rides through his association with Mrs Zimmerman's stable.
