Facts:
Following the running of Race 5 Stewards charged Mr Tim Robertson with a breach of r 869 (3) (b) – careless driving – in that he allowed his horse MISS JESSICA to strike the wheel of TOLKIEN about the 1400 metres mark causing MISS JESSICA to break from its gait. Mr Robertson admitted the breach and appeared at the hearing.
Mr Munro, with the use of the video replay, said MISS JESSICA was racing three back on the pole line trailing TOLKIEN as the field approached the 1400m mark. Ms Haley stated that shortly after, the lead changed and there was slackening of the pace. As a result MISS JESSICA struck the wheel of TOLKIEN and broke. The sulky tyre of TOLKIEN was punctured as a result. She said MISS JESSICA was racing keenly at the time.
Mr Robertson stated that MISS JESSICA was racing keenly just prior to the incident and that the pace had slackened. He said the mare was still learning about racing.

Ms Haley stated Mr Robertson had had 40 drives last season and 34 this season. He had an excellent record with no previous breaches of the rule. She said the JCA Penalty Guide recommended a starting fine of $300.
Mr Robertson said he had admitted the charge and would prefer a fine as opposed to a suspension.
Reasons for Penalty:
Mr Robertson has two mitigating factors in his favour. Firstly, that the pace had eased significantly and secondly his horse was over-racing prior to it striking the wheel of the forward runner. While the JCA Penalty Guide recommends a fine of $300 Mr Robertson deserves some credit along with admitting the breach.
