As Ms Newman admitted the breach the Committee found the charge proved.

Penalty:

Pursuant to Rule 1106(2) the Committee granted Ms Newman a deferment.

Accordingly, Ms Newman’s license to ride in races is suspended for a period commencing after racing on 6 June 2019 and concluding after racing on 14 June 2019 (5 national days).

Facts:

Following the running of race 2, Celebrating Santa Monica 1200, an Information was filed by Senior Stipendiary Steward, Mr M Williamson, pursuant to Rule 638 (1)(d). He alleged that Ms Newman permitted her mount IMBLAZE to shift inwards when not sufficiently clear dictating POWER O’HATA inwards crowding FIRE JET which was checked near the 1100 metres.

Ms Newman acknowledged that she understood the Rule and confirmed her admission of the breach. She was supported at the hearing by her Agent Mr A Raklander.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Using available video footage Chief Stipendiary Steward Mr Oatham identified the horses involved in the incident namely POWER O’HATA (G Grylls) and FIRE JET (R Scott), as the field approached the 1100 metre mark. He said that Ms Newman angled her mount in when only a bare length clear of POWER O’HATA. As a consequence Mr Grylls had to take a hold of his mount and FIRE JET who was trailing that runner had to be checked and lost ground.

Ms Newman advised the Committee that her mount dictated POWER O’HATA inwards and as a result FIRE JET was checked and lost 1 ½ lengths.

Submissions for Penalty:

Mr Williamson produced Ms Newman’s riding record which showed 2 previous breaches for careless riding in the last 12 months. The most recent being on 14 April 2019 which resulted in an 8 day suspension. He described the breach as low range due to her miscalculating the angle of her inward shift.

Ms Newman advised the Committee she had confirmed riding engagements up to and including 6 June 2019 and asked the Committee to consider a deferment to her proposed suspension. She asked the Committee to take into account her good record and her admission of the breach.

Reasons for Penalty:

The Committee considered all the evidence and submissions presented.

When reviewing the video films the Committee found that Ms Newman permitted her mount to shift in when only ¾ of a length clear of POWER O’HATA. As a result that runner was crowded and in turn it caused FIRE JET to be checked losing 2 lengths. In our assessment the level of carelessness was low range.

The JCA Penalty Guide recommends that the starting point for a low range breach is 6 days which we adopted.

There were no aggravating factors.

The mitigating factors that we took into account included Ms Newman’s admission of the breach and good riding record under this Rule. These collective factors resulted in a 1 day reduction from the 6 day starting point.
