As Ms Collett admitted the breach we find the charge proved.

Penalty:

We grant Ms Collett's request to seek a deferment to her suspension as per Rule 1106(2)

Accordingly, we impose a suspension on Ms Collett which will commence after racing on 19 January and conclude after racing on 27 January 2013 (5 North Island days).

Charge:

Careless riding.

Facts:

Following race 8, an information was filed pursuant to Rule 638(1)(d). The informant, Mr Williamson, alleged that passing the 300 metres Ms Collett (CORPORAL LINCOLN) shifted out to obtain clear running dictating (APACHEE TAAT) L Innes out, causing (ALSUKAR) S Shirahama to be checked losing ground.

Submissions for Decision:

Mr Robinson showed the committee on the video films that at the 350 metres Ms Collett was on the rails and travelling very well. Shortly after this point she angled her mount out when not the required distance clear of Mr Innes. In doing so this forced Mr Innes's mount out onto Mr Shirahama's, who received a severe check.

Ms Collett told the committee that her mount was travelling pretty well on the rails and was looking to improve. She conceded that she was not clear of Mr Innes which resulted in Mr Shirahama's mount being affected.

Submissions for Penalty:

Mr Williamson submitted that Ms Collett had 1 previous breach under this rule in the last year and described her record as excellent. He said Mr Shirahama's mount did receive a severe check. However, he was of the view the horse was racing ungenerously and had poor racing manners. He assessed the level of carelessness as mid range.

Ms Collett submitted that she had firm commitments up to and including Counties on January 19. She requested a deferment to her proposed suspension and stated that she rode all over the North Island.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors are Ms Collett's admission of the breach and her very good record. However, this has to be balanced against the significant aggravating fact that Mr Shirahama received a severe check which we assess as mid range. We note that Ms Collett moved out sharply and approximately 3 horse widths. Taking into account all the above factors we assess an appropriate penalty is 5 days.
