Facts:
Following the running of Race 1 the “Tavern Harewood Amateur Drivers Mobile Pace” an Information was filed by Stipendiary Steward Mr S Renault alleging a breach of Rule 869(2) by Amateur Driver Mr M Stratford. The information alleged, You used your whip on more occasions than permitted by Clause (b) of the Use Of Whip Regulations.
Mr Stratford had signed the Information stating he admitted the breach and that he did not wish to be present at the hearing. This was confirmed by Mr Renault.
Rule 869 provides as follows:
(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulation made by the Board.
The Use of Whip Regulation (effective from 30 November 2017) provide:
(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.
Mr Renault used the race video with the assistance of Mr Ydgren to identify Mr Stratford driving (11) PEMBROOK BLUE, racing four places back on the rail at the 400 metres. He pointed to Mr Stratford and counted 11 strikes with the whip in the run to the finishing post. Mr Renault stated there were also several taps with the whip but 11 very clear strikes.
Mr Renault stated Mr Stratford had no argument with the count of 11 strikes.
Submissions for Penalty:
Mr Renault said Mr Stratford had driven 14 times this season and had a clear record under this rule.
Mr Renault said the Stewards were seeking a fine of $200.
Reasons for Penalty:
The JCA Penalty Guide provides a sliding scale for a first offence where there have been 11 to 13 strikes which entails a $200 fine, mitigation inclusive.
The Committee finds this an appropriate penalty.
