Facts:

Following the running of Race 9, the JOHN KEENAN MEMORIAL MOBILE PACE , an information 13732 instigating a protest was laid by Mr Ydgren (Stipendiary Steward) alleging that under rule 870 (5) horse No 9 (I Am Legend) broke when crossing the finishing line.

The Judges Placings were:

1st I Am Legend (9)

2nd Commander in Chief (6)

Submissions for Decision:

Mr Ydgren used video film of the race finish to show where I Am Legend actually tried to jump or leap over a distinct line at the finish . This distinctive line was caused by the sun shining from the finish line mirror shining directly across the track. Mr Ydgren explained the rule and went on to describe the exceptional circumstances that brought about this unique bright line on the track at the finish. Mr Ydgren explained that the mirror was covered up during preliminaries and only appeared during the finish when the bright sun was shining. Mr Ydgren suggested that the Committee consider the fact that the interference occurred as a result of circumstances "outside" the actual race.

The Committee considered the film evidence presented. The Committee was satisfied that the incident was caused by factors outside the race.
