The Protest is not contested and accordingly it is upheld. Horse 1 BROOKBY PRINCE is disqualified from the Race.

The amended placings are now : First (5) SUNSHIELD

                                                 Second (8) LEANNE'S BOY

                                                 Third  ( 6) OUR SUPER RAM

                                                 Fourth (3) CELERIS

                                                 Fifth (2) TORBJORN

                                                 Sixth (9) BUNNY'S GEM

It is ordered that Dividends and Stakes be paid in accordance with the amended placings.

Facts:

An Information was lodged by Stipendiary Steward Mr NG McIntyre against the 4th placing of BROOKBY PRINCE (Driver AG Grayling) on the grounds that it broke and galloped in excess of 50 metres inside the last 200 metres.

Rule 870(3) provides that any horse which breaks from its gait shall promptly regain its proper gait. Part B of the Breaking Horse Regulations provides that any horse that breaks from its gait in the final 200 metres of the Race and continues in a break in excess of 50 metres shall be deemed to be in breach of Rule 870(3).

Mr AG Grayling the Trainer and Driver of BROOKBY PRINCE endorsed the Information with the words " I do not contest the Protest ".

Stipendiary Steward Mr JM Muirhead demonstrated the incident by use of the Race films. He showed where BROOKBY PRINCE broke in the straight and galloped for 90 to almost 100 metres.

Submissions for Decision:

Mr Muirhead submitted that BROOKBY PRINCE had galloped in excess of 90 metres and was in breach of the Rule and should be disqualified from the Race.

Reasons for Decision:

The Race films show the incident clearly and the Protest is not contested.
