As the breach was admitted we find the charge proved.
Penalty:
Accordingly and under the provisions of rule 1106 (2) we suspend Mrs Satherley from riding in races which is to start after racing on 12 November and conclude after racing on 22 November 2012 (6 days).

Facts:
Following race 8 an information was filed pursuant to rule 638(1)(d). Mr Oatham alleged that Mrs Satherley angled her mount SIEM REAP outwards passing the 400 metres when insufficiently clear of ASPINAL which was crowded onto FAZZLE and severely checked.
Submissions for Decision:
Mr Coles demonstrated the video films which showed SIEM REAP racing in the middle of the track and well back in the field at the 400 metres. Sooner after this point Mrs Satherley angled her mount outwards and into the line of ASPINAL which was racing inside FAZZLE. Mr Coles submitted that this movement caused ASPINAL to be turned sideways and receive a severe check. He said Mrs Satherley had moved out 2 to 3 horse widths in the incident.
Mrs Satherley had no submissions to make when asked.

Mr Oatham told the committee that Mrs Satherley had only incurred 1 suspension in the last 12 months. As 2 horses had their chances extinguished resulting from her interference he considered this breach to be at the high end. He reminded the committee this was a listed race for $50,000 and submitted a suspension of 6 to 8 days would be appropriate.
Mrs Satherley said she had commitments until after the conclusion of racing on 12 November.

The committee carefully considered all evidence and submissions. In Mrs Satherley’s favour are her admission of the breach and her excellent riding record. In contrast the aggravating factors are the severe checks to 2 horses caused by Mrs Satherley angling out when insufficiently clear. We have also taken into account the status of the race. The committee finds Mrs Satherley’s carelessness to be at the high end. We explained to her this breach would normally warrant a 7 day suspension but because of her excellent riding record and her admission of the breach we reduce this to one of 6 days.
