Facts:
Mr Kwo was charged with a breach of careless riding r 638(1)(d) in that he allowed his mount LOCHAN ORA to shift outwards checking SHAKTI (K Mudhoo) with approximately 150 metres to run. Mr
Kwo admitted the charge and was assisted by Mr Moseley.
Miss Hayley identified the runners on the video replays leading up to the interference.
Mr Davidson stated that LOCHAN ORA was improving its position from near the tail of the field on entering the home straight. Mr Kwo had shifted his mount outwards and had continued to ride his mount out in close quarters. As a result SHAKTI was cramped for room and Mr Mudhoo was forced to check his mount. He said there was inside movement which did affect LOCHAN ORA prior to the incident, and also SHEZATOUCHA had drifted inwards which had contributed.
Mr Kwo stated he believed he had an opportunity to finish in a stake bearing position and had ridden his mount out.
Mr Moseley stated Mr Kwo could have straightened his mount earlier but had been slow to react. He said other horses shifting ground prior to the interference were mitigating factors which should be taken into account.

Mr Davidson said Mr Kwo had admitted the breach and had an excellent record with no previous charges or any other charges for the past two years. He’d had 197 rides up until today’s meeting. He said there were mitigating factors to the incident, other runners shifting ground and tight racing. He sought a suspension at the low end of the scale.
Mr Kwo asked that a suspension start after racing on December 28th to allow him to ride at Timaru.

We have taken into account Mr Kwo’s guilty plea, his outstanding record over the past two years and the mitigating factors that other runners contributed to the interference and give him credit. A five day suspension is appropriate.
