Accordingly the committee is satisfied that if interference had not occurred RED STRIKER would have beaten ONLYAROSE.
Therefore the protest is upheld and the results shall now be:

Facts:
Following race 8, the Hall Mark Stud Handicap, a protest was lodged pursuant to rule 642(1) by Mr J Collett. He alleged that ONLYAROSE placed first by the judge interfered with the chances of his horse RED STRIKER placed second by the judge. He said this occurred in the final straight.
The judges placing were as follows:
1st - No 9. ONLYAROSE
2nd - No 10. RED STRIKER
3rd - No 2. IRISH MOON
4th - No 5. MISS FOXWOOD
The margin between first and second was a head.
Rule 642(1) reads: if a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the judicial committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.
Submissions for Decision:
The informant, Mr Collett demonstrated the video films pointing out his horse RED STRIKER racing on the rail and approximately 4 to 5 lengths behind ONLYAROSE at the 400 metre mark. He said at the 200 metres ONLYAROSE has shifted out off her line and in doing so knock RED STRIKER sideways while taking a gap she was entitled to. Mr Collett said at this stage ONLYAROSE was tiring while RED STRIKER was finishing at a great rate. He concluded by saying he had no doubt RED STRIKER would have won easily if she had not received the interference.
Miss S Collett opened her evidence by saying she was 5 lengths behind ONLYAROSE at the 350 metres. She said soon after this there was a clear run for her to take at a stage when she was 1 1/2 lengths behind ONLYAROSE. Miss Collett demonstrated on the film ONLYAROSE moving out and making contact with her which impeded her use of the whip. She added that RED STRIKER was a very small horse and became unbalanced through ONLYAROSE laying on her. She said there was contact on two occasions between the two horses and with the large amount of ground she made up she was sure she would have won the race if she had not received interference.
Mrs Fursdon conceded the two horses were racing in cramped quarters but believed Miss Collett had every chance to get past her horse.
She concluded by saying Miss Jones had the stick in her left hand and was doing her best to keep straight.
Miss Jones said ONLYAROSE does not go well right handed and has lugged out slightly. She believed this also cost her some momentum but conceded they did make contact although she was pulling on the right rein.
Mr Oatham said it was clear ONLYAROSE was laying out under pressure but believed this did not cause a problem early in the run home.
He said however that at the 150 metres ONLYAROSE did move out when not clear placing RED STRIKER in restricted room for some distance. Mr Oatham added that it was only in the final six strides that RED STRIKER could be fully ridden out and that she made up a number of lengths on ONLYAROSE in the final stages. He concluded that the protest had merit and the committee had to, decide whether RED STRIKER had lost more than the head margin through the interference.
Reasons for Decision:
The committee carefully considered all evidence and submissions and reviewed the available video footage several times. The films clearly show that at the 400 metres RED STRIKER is 4 lengths behind ONLYAROSE. At the 175 metres there was a gap on the outside of ONLYAROSE which RED STRIKER was entitled to take. It was then evident at that point ONLYAROSE shifted out hampering and causing interference to RED STRIKER for some distance placing Miss Collett in restricted room and unable to use her whip to advantage. The committee noted that in the last 75 metres when RED STRIKER had clear racing room she was finishing very strongly and making considerable ground (3/4 of a length) on ONLYAROSE to be within a head at the winning post. The committee is of the opinion that the interference RED STRIKER received from ONLYAROSE cost her more than the head margin which was the distance between the two horses at the post.
