Mr Campbell admitted the breach and it is found proved.

Penalty:

Mr Campbell is suspended from the completion of racing at Timaru on the 4th April up to and including the 13th April (seven national riding days).

Facts:

Following the running of race 10 the AB Lime & Torresdale Suffolk Stud Longwood Handicap stewards charged Mr C Campbell (The Energizer) with a breach of excessive use of the whip in that he “…used his whip in an excessively prior to the 100m.”

Rule 638 (3) (b) (ii) reads: A Rider shall not:

(b) strike a horse with a whip in a manner or to an extent which is:

(i) unnecessary (ii) or excessive (iii) or improper

The guidelines read: Without affecting the generality of Rule 638(3)(b), a rider may be penalised if their whip use is outside of the following guidelines: Inside the final 600 metres of a race, official trial or jump-out a horse may be struck with the drawn whip up to five times after which the rider must cease their use of the whip for a minimum of five strides before striking the horse again with the drawn whip, with this restriction to apply prior to the final 100 metres. The whip may then be used at the rider’s discretion until the winning post is reached.

Mr Campbell admitted the breach and appeared at the hearing assisted by Mr Walsh.

Mr McLaughlin, with the aid of the videos, stated Mr Campbell, in the home straight, struck his mount nine times prior to the 100 metre mark. He said the strikes were continuous without the required break. Mr Tidmarsh stated Mr Campbell’s use of the whip was quick-fire. He gave his mount a break just before the 100 metre mark, but by then it was too late.

Mr Walsh stated it was a clear breach of the guidelines and the rule. He said it was Mr Campbell’s whip action that was a contributing factor. Once that was sorted out his whip use would improve. Mr Campbell said he had turned his whip over, but it was too late at that stage.

Submissions for Penalty:

Mr Tidmarsh stated this was Mr Campbell’s third whip charge in two days and his second today. His record had been discussed at the two previous hearings. The JCA Penalty Guide recommended a suspension of 6-8 national riding days for a third offence. He said the breach was low-mid level, but was his third breach in two days. He sought a suspension of seven national riding days.

Mr Campbell said he had confirmed rides at Timaru on the 4th April and asked that any suspension start from the completion of racing on that day.
