As Miss Taylor admitted the breach the charge was found to be proved.

Penalty:

Accordingly after taking all the above factors into account we impose a fine of $200.00.

Charge:

Following race 10 an information was lodged alleging a breach of rule 610 (4) in that Miss Taylor had in her possession a modified body protector.

Facts:

Mr Coles told the committee that at the Tauranga races on 25 June 2011 a number of riders had been spoken to and warned that the stewards would be checking for compliance of safety vests.

A check of all riders’ vests was done today and Miss Taylor’s vest, which was an approved type, was found to have the tail section of pads removed and modified with non regulation pads.

Miss Taylor admitted that she was responsible for replacing the pads.

Mrs Logan explained to Miss Taylor it was like driving a car you must have a current warrant of fitness. She reminded Miss Taylor that the body protector is designed to protect her spine.

Submissions for Penalty:

Mr Coles submitted that Miss Taylor did have in her possession a modified body protector which is a clear breach of the rules. Miss Taylor had no previous breaches of the rule. Mr Coles’ submission was for a fine of $200.00 which was imposed in a body protector incident at Egmont Racing Club yesterday.

Miss Taylor told the committee she has purchased a new body protector.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions as presented. We also had the opportunity to inspect the vest and the modifications made to it.

Mitigating factors are Miss Taylor’s admission of the breach, no previous breaches of the rule. The rest of her vest was found to be in very good condition.

The aggravating factor is Miss Taylor was warned by the Stewards last Saturday at the Tauranga race meeting that her vest did not comply.
