Mr Hill is fined the sum of $250 and was reminded of his professional obligations.

Facts:

At the conclusion of Race 8, The Todd Realty Mobile Pace, Information A10669 was lodged by Stipendiary Steward, Mr V Munro alleging Junior Driver, Mr M Hill (Mach’s Back) struck a wheel (Benio Ben) driven by B Barclay, passing the 300 metres mark.

Mr Hill was present at the hearing and confirmed he admitted the breach and that he understood the Rule.

Mr Davidson used the video clips pointing out that Mr Hill, who was trailing BENIO BEN has moved out striking the wheel of this horse. The video clip clearly shows Mr Barclay looking down immediately after the contact was made.

Mr Cox supporting Mr Hill stated that Mr Hill had made a simple error of judgement.

The Rule 869(3)(b) reads:

No Driver in any race shall drive carelessly.

Submissions for Penalty:

Mr Munro stated that Mr Hill was a Junior Driver, in his first season of driving.  Mr Hill has had 55 lifetime drives, having recorded two wins and this was his first breach of the Rule.

Mr Munro added that he believed the range of carelessness was low to mid. Mr Munro also stated that Mr Hill had also admitted the breach right from the outset of the investigation.

The JCA Penalty Guide recommends a 6-drive suspension or a $300 fine.

Mr Munro believes a fine in the vicinity of $300 may be appropriate.

Mr Hill reinforced that he had made an error of judgement, and that he was a Junior Driver with limited opportunities.

Reasons for Penalty:

Mr Hill’s breach of the Rule was at the lower end of the scale although BENIO BEN was clearly affected. Taking into account Mr Hill’s good record and his very early admission of the breach a $50 credit was applied.
