Decision:

As Miss Grylls admitted the breach we find the charge proved.

Penalty:

We grant Miss Grylls' request to seek a deferment to her suspension as per Rule 1106(2).

Accordingly, we impose a suspension on Miss Grylls which will commence after racing on 30 January and conclude after racing on 6 February 2014 (4 North Island days).

The penalty did not include any South Island meetings as Miss Grylls confirmed that she did not intend riding there.

Facts:

Following the running of race 5, Putauaki Trust Cup, an information was filed pursuant to Rule 638 (1) (d). The Informant, Mr Oatham, alleged that Miss Grylls permitted her mount DANCING EMBERS to shift outwards when not sufficiently clear of LIBERARE which was checked near the 400 metres.

Miss Grylls acknowledged that she understood the nature of the charge, the Rule and confirmed her admission of the breach. Miss Grylls was assisted at the hearing by trainer Mr P Lock.

Rule 638(1) (d) provides A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Robinson identified on the video films DANCING EMBERS racing adjacent to the running rail with LIBERARE racing on its outer near the 400 metres. He pointed out were Miss Grylls angled her mount out into a 3 wide position when barely a length clear of LIBERARE, this caused Mr Hutchings to check his mount which in turn caused a chain reaction to several horses on his outside.

In response to a question from the Committee, Mr Robinson believed this incident cost LIBERARE approximately 2 lengths.

Miss Grylls acknowledged that she had taken Mr Hitchings' rightful line of running. She added that DANCING EMBERS was a lazy horse and had moved out awkwardly when she tried to ride forward into the available gap.

Mr Lock agreed that it appeared Miss Grylls had misjudged the manoeuvre.

Submissions for Penalty:

Mr Oatham produced Miss Grylls’ record which showed no previous breaches under this Rule in the last 12 months. He said Miss Grylls ought to be given credit for her admission of the breach and very good record. He said the aggravating factors were the level of carelessness which he assessed as mid - range with the consequences being reasonably severe. He noted LIBERARE lost 2 lengths and ran on to finish in 4th place. Mr Oatham submitted a suspension in the 4 to 5 days range was warranted.

Miss Grylls advised that she had upcoming commitments at Hastings on January 30, and any proposed suspension could commence after that.

Miss Grylls confirmed that she had no intention of riding at Banks Peninsula on February 3.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Miss Grylls’ admission of the breach and her excellent record in relation to this Rule. The aggravating fact is we assess the level of carelessness as mid – range which had an impact on the progress of LIBERARE. We note that several horses on his outside were inconvenienced by the outward movement.

After taking into account all the above factors we consider an appropriate penalty is a 4 day suspension.
