As Mr Cameron had admitted the breach, it was found to be proved in accordance with Rule 638 (3)(b).

Facts:

Following the running of Race 2, The Planet Rock Maiden, an information was filed by Stipendiary Steward Mr N Ygdren alleging a breach of Rule 638 (3) (b) by Licensed Jockey Mr M Cameron in that he used his whip in an excessive manner.

The information reads as follows:

"Mr Cameron used his whip to excess prior to the 200m"

Rule 638 (3) (b) reads as follows:

"(3) A Rider shall not:

(b) strike a horse in a manner or to an extent which is unnecessary, excessive or improper"

Mr Cameron had indicated on the information that this breach was admitted, and he confirmed this at the hearing.  Mr Cameron also agreed that he understood the charge and the Rule it was brought under.

Submissions for Decision:

Mr Ydgren illustrated by the use of race video, that Mr Cameron was in the lead on "Astronomical" prior to the 200m mark, when he had used the whip 10-11 times without the respite required under the relevant guidelines of "6 on and 6 off".

Mr Cameron did not dispute the facts as outlined by Mr Ydgren.

Submissions for Penalty:

Mr Ydgren submitted that the offending was at the low end of the scale, that Mr Cameron had entered an early guilty plea and had co-operated fully.  He added that Mr Cameron had previously breached this Rule on 12th February 2012 when he had struck his mount 18 times, but the present offending was much less serious and that Mr Cameron had ridden in a large number of races since.

Mr Ydgren submitted that he believed a fine of $200.00 was appropriate.

Mr Cameron was given the opportunity but made no submissions.

Reasons for Penalty:

The Committee considered that in view of the breach on 12th February 2012, the starting point for penalty should be $300.00.  We considered a higher starting point but took into account Mr Cameron's comparatively good record considering the number of rides he has taken as outlined by Mr Ydgren.

We took into account the submissions made by Mr Ydgren who considered the breach to be at the low end of the scale.  We concurred with this observation after having viewed the race video.  Also Mr Cameron had co-operated fully and admitted the breach at an early stage.

Taking all these mitigating factors into account we determined a fine of $200.00 was appropriate.
