As Ms Fawcett admitted the breach, the charge was deemed proved.

Accordingly, Ms Fawcettt is fined the sum of $300.

Facts:

Following Race 1, Mr Goodwin lodged an information with the Judicial Committee alleging a breach of Rule 638 (3) (b) (ii) in that J Fawcett used her whip excessively prior to the 100m on her mount TOUCH THE CLOUDS.

At the outset of the hearing, Ms Fawcett confirmed that she understood the Rule and that she admitted the breach. Ms Clapperton was assisting in her role as Central District’s riding mentor.

Mr Balcombe showed on the video where Ms Fawcett struck her mount a total of 8 times before the 100m mark. There were two instances of consecutive use. Ms Fawcett was satisfied with the stewards’ description of the breach.

Submissions for Penalty:

This is Ms Fawcett’s first breach since all riders’ whip records were reset with the implementation of the new guidelines on October 7th 2019. Mr Goodwin said the Stewards' submission was for a penalty in line with the new regime.

Ms Fawcett said that she had had a hectic period of riding over the last 2 weeks and although this wasn’t an excuse she asked the Committee to take that into consideration. She also said that her employer, Mr Autridge, would be giving her extra manual work around the stable as a result of today’s breach.

Ms Clapperton said Ms Fawcett was riding the favourite and this placed extra pressure on an apprentice rider.

Reasons for Penalty:

The Penalty Guide for Judicial Committees provides the following starting points for breaches of Rule 638(3) (b) (ii):

1st breach---$300

2nd breach---$500

3rd breach- suspension

Ms Fawcett was three-over the new limit of 5 permissible strikes of the whip before the 100m mark. The Committee was concerned that not only was Ms Fawcett over the guidelines but she continued to use the whip while her mount was clearly running inwards. Mr Goodwin confirmed that he would be issuing Ms Fawcett with a warning for careless riding as a result.

We advised Ms Fawcett that we were affording her some leniency due to this being her first breach under the new guidelines. The starting point for a first breach is $300, and the Committee deemed this to be an appropriate penalty today.
