Horse 2 Oto Invasion is relegated to finish behind the second placed horse Jimmys Girl and the judges placings are amended as follows

1st  6   Jimmys Girl

2nd   2   Oto Invasion

3rd   7   Phoebe Gladiator

4th   3   Milldorf

5th   10   Sunover Dover

6th   9   Bon Ton Cherie  

Authority to pay dividends on amended placings was authorised.

Facts:

Following the running of race 2 an information lodging a protest was laid by the Stipendiary Stewards on behalf of the connections of horse 6  Jimmy's Girl placed 2nd by the judge against the first placed horse Oto Invasion on the grounds that Oto Invasion had broken from its gait and galloped  breaching the lapped on rule as it crossed the finishing line.

The Judges placings were

1st   2   Oto Invasion

2nd   6   Jimmys Girl

3rd   7   Phoebe Gladiator

4th   3   Milldorf

5th   10   Sunover Dover

6th   9   Bon Ton Cherie

Mr Taumanu informed the hearing that he had received a phone call from trainer Mr S McCaffrey following the race.  He had  confirmed that from watching the concluding stages of the race he did not wish to contest the protest but was unavailable to immediately appear for the hearing.  Driver Mr J Stormont was present to represent the connections and endorsed the information on behalf of Mr McCaffrey to this effect.

Video footage of the concluding stages of the race showed that Oto Invasion broke free of interference in the final 20 metres of the race and continued in this state through the finish line being lapped on by the second placed horse Jimmy's Girl in doing so.

Submissions for Decision:

Stipendiary Steward Mr Taumanu told the committee that the relevant rule had been clearly breached and sought the relegation of Oto Invasion behind the second placed horse.

Reasons for Decision:

The relevant rule dictates that any horse on reaching the finish line not in its correct gait and being lapped on by another shall be relegated behind any such horse.
