Facts:
Following the running of Race 3, Game Bid Trot, an information was filed by Stipendiary Steward, Mrs K R Williams against Licensed Junior Driver, Mr L D McCormick, alleging a breach of Rule 862 (2) in that, as the driver of LITTLE TOMTOM in the race, he “permitted his horse to start in the incorrect barrier position”.
Mr McCormick was present, assisted by Licensed Open Horseman, Mr C D Thornley, at the hearing of the information and he indicated that he admitted the breach. The breach was found proved accordingly.
Rule 862 provides as follows:
(2) No horseman shall permit a horse to start and no horse shall start other than from its correct barrier position (either at a standing or mobile start), unless directed by the Starter in accordance with Rule 860 (8).
Submissions for Decision:
Mrs Williams informed the Committee that, in Race 3, there were four horses on the unruly mark for the 2600 metres standing start event – WESTMELTON WILLIE (U1), SPOT ON GAMBLE (U2) driven by Miss Ottley, LITTLE TOMTOM (U3) driven by Mr L D McCormick and TIP YOUR HAT LOUI (U4). Mrs Williams said that SPOT ON GAMBLE and LITTLE TOMTOM had started from U3 and U2 respectively. The two horses had, effectively, swapped starting positions. Both drivers were equally at fault, Mrs Williams submitted. Mrs Williams showed a video replay of the start of the race which clearly confirmed her allegation.
She submitted that no pressure had been put on either driver by the other. There had been ample time before the horses’ lining up and a start being declared for both drivers to draw the attention of the starter. There was a clear gap between the two horses. The obligation was on a driver to ensure that he or she started from the correct barrier position.
Mr Thornley, on behalf of Mr McCormick, submitted that Mr McCormick had gone into the correct position and had heard Miss Ottley call out. It was a natural reaction to think there was somebody outside him and he had moved down. It was a “genuine mistake”, he submitted.
Mr McCormick said that he was aware that he was to start on the inside of TIP YOUR HAT LOUI, driven by D J Dunn, which had drawn U4. He explained that he was driving a horse, in a junior drivers’ race, that he had not driven before. He knew nothing about the horse and was anxious to give it every opportunity to begin safely.
Submissions for Penalty:
Mrs Williams submitted that a fine of $200 was appropriate, which submission took into account Mr McCormick’s junior driver status. She referred to the fine of $200 imposed on Miss Ottley and to the fine of $200 given to another driver in July 2010 for a breach of the same Rule.
Reasons for Penalty:
In determining penalty, the Committee had regard to Mr McCormick’s admission of the breach and his junior driver status. The Committee was aware of two recent breaches of the Rule that were dealt with by fines of $250 and $200. The Committee also took into account the submissions of Messrs Thornley and McCormick.
The Committee decided that it was appropriate and consistent to deal with Mr McCormick in the same manner as Miss Ottley had earlier been dealt with.
