Charge:
Following the running of race 7, Information A3454 was filed by Stipendiary Steward Mr R Neal under rule 638(3)(c). The information stated that "P Holmes struck his mount RAGLAN ROAD forward of the shoulder in the home straight".
Rule 638(3)(c) states - " A rider shall not strike a horse forward of its shoulder...."
Mr Holmes confirmed he understood the charge and the rule it was laid under.
Facts:
Mr Neal used the head on film to identify Mr Holmes on RAGLAN ROAD. He said that on entering the home straight the horse was beginning to tire and lay out. Approximately half way down the straight when out of contention Mr Holmes was seen to strike RAGLAN ROAD 5 times - Mr Neal said two of the strikes were on the top of the shoulder with the other three being clear strikes on the horse's neck.
Mr Holmes had no comments to make on Mr Neal's interpretation of the film other than to say his actions were unintentional.

Mr Neal said this was Mr Holmes' first breach of the rule. He said RAGLAN ROAD was hanging out and beginning to tire and he had tried to straighten the horse but his striking of the horse forward of the shoulder went too far. He described the incident as being at the low end of the scale as the striking was not over a prolonged period or manifestly excessive. Mr Neal said in a recent similar case a jockey had been fined $200 and he submitted that a similar penalty would be appropriate in this case.
Mr Holmes had no submissions to make on penalty.

The Committee has considered the evidence provided by the head-on film of the incident. It is clear Mr Holmes struck RAGLAN ROAD 5 times on or forward of the shoulder over a distance of approximately 100m in the home straight when the horse was tiring and out of contention. We have also taken into account Mr Holmes' admission of the breach and that prior to today he has not been charged under this rule. However, his actions were clearly seen on television and would not have looked good when viewed by members of the public. The Committee is aware of the recent decision when a jockey was fined $200 for a similar offence and sees similarities between that offence and today's and believes a similar penalty should be given.
