As Mr Prastiyou has admitted the breach, we find the breach proved.
Penalty:
Mr Prastiyou is suspended from the end of racing today up to and including 27 February. This is 4 South Island days.
Facts:
Mr McIntyre alleged that in race 7, the FIRE & MECHICAL DUNEDIN GOLD CUP Mr Prastiyou, the rider of PUDDLE ALLEY, had ridden carelessly in that he allowed his mount to shift in at the 2000 metres causing checks to ROHAISE (S Collett) and BLUE N’GOLD (T Direen).
Mr McIntyre demonstrated on the videos that the respondent had drawn one from the outside and had ridden his mount forward when the gates opened. Mr Prastiyou’s horse was racing keenly and when he was in a 3 wide position he shifted in and placed pressure on the 2 horses to his inner, which were ROHAISE (S Collett) and BLUE N’GOLD (T Direen). Mr McIntyre accepted that ROHAISE was racing fiercely and Ms Collett had had to take a hold, but this was exacerbated by her receiving pressure from her outside from the respondent. He said essentially 3 horses were vying for 2 spots on the track. Ms Collett was forced to take a firm hold and BLUE N’GOLD was pushed on to the fence as consequence of Mr Prastiyou’s actions. The horses were both checked and he assessed that each lost a couple of lengths. Mr McIntyre said he could hear the riders yelling from his position at the top of the stand, and the respondent had failed to relieve the pressure.
Mr Prastiyou acknowledged “the videos show everything” and did not disagree with Mr McIntyre’s description of the incident.
Mr Kennedy emphasised that Ms Collett’s horse was over-racing at the time and continued to over-race, but he accepted Mr Prastiyou’s actions had not helped Ms Collett. He believed ROHAISE had chased up once it saw PUDDLE ALLEY coming across. He said the respondent’s actions were a misjudgment but added the horse was laying in of its own accord as well.
Submissions for Penalty:
Mr McIntyre produced the respondent’s record, which evidenced no breach of this rule in the past 2 seasons. He emphasised race 7 was a listed race and the level of interference was in the mid to high range. He submitted a 5-day suspension was appropriate.
Mr Kennedy did not disagree with Mr McIntyre’s assessment of the gravity of the breach but he asked the Committee to consider a lesser suspension. He emphasised that the respondent was a South Island apprentice with a good record who had made an error of judgment and 5 days was a long time in South Island days.
Reasons for Penalty:
The breach is at the high end of mid range. Mr Prastiyou has crossed across the front of the field when not his length and another clear and has placed pressure on 2 horses. The inwards movement has continued for some time, despite yelling by the affected jockeys. Two horses have had to be checked, with one making firm contact with the rail. We accept that Ms Collett’s mount was already racing fiercely at the time, but the respondent’s actions only added to her difficulties.
Mr Prastiyou has admitted the breach, his record is very good in that he has had no breaches of this rule in the past 2 seasons, and he is a relatively busy South Island apprentice jockey.
We take a starting point of 5 days and raise it 2 having regard to the gravity of the breach and the listed nature of the race. We give a day’s discount for each of the 3 mitigating factors: viz, very good record; admission of the breach; and the fact he is a South Island rider with limited riding opportunities.
